Limited Liability Indemnity

This page sets out the limits of our liability, and your indemnity to us, when you use tritanglasses.net or buy from Tritan Glasses Canada. It forms part of our Terms and Conditions.

Your rights under the law come first

Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by negligence, for fraud, and any right under the consumer protection law of your province or territory that cannot be given up. If the law where you live does not allow a limit on this page, that limit does not apply to you.

Limitation of our liability

Subject to the section above, and to the fullest extent the law allows, we are not liable for indirect, consequential, special, incidental, punitive or exemplary loss, or for loss of profit, revenue, data or goodwill. Where we are liable, our total liability for any claim is limited to the amount you paid for the goods the claim relates to. We are not liable for damage caused by misuse, by ignoring a product's care guidance, or by normal wear, or for delivery delays outside our control. If we cannot supply something you have paid for, we refund you in full.

Using our products

Our glassware is shatter-resistant, not indestructible, and we do not claim it will prevent injury or loss. Use it for drinking and serving and follow the care guidance on its product page. Except where we have acted fraudulently or with wilful misconduct, and subject to your rights above, you are responsible for how you use the products.

Website availability and third parties

The site is provided "as is" and we do not promise uninterrupted or error-free access. We are not responsible for fraud, hacking or other unlawful acts by third parties outside our control. This site and our products are meant for customers in Canada.

Your indemnity

You agree to cover our reasonable losses, costs and claims, including reasonable legal fees, that arise because you have broken our Terms and Conditions, misused this site or a product, or infringed another person's rights through your use of the site. Nothing here requires a consumer to cover us for our own breach or negligence.
